What is the ACC and how does it affect you and your property? What are the specific deed restrictions on your property and why are they important to you and your neighbors?
The Balcones Village/Spicewood (BV/S) area is currently included within the City of Austin as well as being a part of the BV/S development. As a result, the properties that are included in that area are subject to the City of Austin ordinances, regulated by City of Austin codes, and also covered by the BV/S Deed Restrictions that were filed by the developer when the property was orignally platted. Owners of property and/or residents that are considering changes or improvements to property within the BV/S sub-divisions will need to contact both the City of Austin as well as the BV/S Homeowners Association (HOA) Architectural Control Committee (ACC) to obain the review and approvals necessary to ensure that the improvements that they intend to make are consistent with what has been defined for the area in general, and specifically their property. The ACC is composed of five members who are responsible for providing assistance to homeowners in the BV/S residential area by reviewing proposed improvements to their property and giving guidance on how those improvements can be done in compliance with the deed restrictions that govern their property. There are 23 unique sets of deed restrictions covering the BV/S development. While they are generally the same, there are some specific differences. In some cases the ACC can grant homeowners an exception or varience from compliance with certain aspects of the deed restrictions. The ACC meets once a month in the Balcones Country Club Clubhouse. One of the members serves as the contact to provide a pre-review and discussion of the questions to help make sure that when the issue is discussed at the monthly meeting all of the necessary information is available. The current contact for the meeting is Doug Bell, whose name is highlighted in the member list. The ACC board is not an enforcement agency. It serves to provide review and approval of homeowner projects; however, enforcement is the responsibility of the homeowners that live within the section. Homeowners who have obtained ACC approval for their projects, are covered in the event of a deed restriction issue that might arise in a Title search related to the sale of the property and also, are generally protected from legal actions for violations of deed restrictions that might be brought by neighbors within their section. Requests for consideration should be sent to the committee a week prior to the meeting. Homeowners are welcome to attend the meetings to discuss their requests with the ACC. If you don't know your section number, you may get that information from the warranty deed for your property or from a real property tax statement.
