Deed Restriction Enforcement Policy Actions Print

All of the homeowners in the Balcones/Village Spicewood area were sent a copy of Enforcement Policy that was approved by the Home Owners Association Board of Directors in response to complaints by a number of homeowners in the area about deed restriction violations and requests that the Home Owners Association do something to help maintain the character and integrity of the neighborhood.

In the recent newsletter that was sent out, it was mentioned that the board was pursuing Enforcement Policy actions with 5 homeowners in the area.  Two of those have since been satisfactorily resolved, but three are still in process.

Today, May 17th, one of the homeowners involved made a posting on the yahoo group.  Much of what was posted was not complete nor accurate.  In response, the following was posted to the yahoo group by Pat Zigrossi, President of the HOA Board.

Earlier, there had been a letter to the attorney that is representing the HOA Board in this matter from an attorney claiming to represent some of the homeowners in the area, including the three properties where there is still no resolution regarding the deed restriction violations.  To help put some perspective on this situation, a copy of the response sent by the HOA attorney is also shown below.

Because these situations are involved with a legal process, we have been advised by our attorney to not discuss them, however, these notes should help provide some information on the nature of the issue and the current status.
